Contracts
As a service provider you will use back-to-back contracts drawn up professionally by lawyers.
The ‘upper’ contract is between you and your client, whilst the ‘lower’ contract is between you and your candidate. These two contracts are carefully designed to work hand-in-hand and therefore, on no account should one be altered without the other being kept in sync.
We have heard of leading providers offering to ‘tweak’ a contract to suit an individual candidate without reflecting the changes in the contract with the client. A recent IR35 court case has shown how costly this can be (over £100,000), with the primary cause being a contract which was not back-to-back.
